1. Acceptance of terms
By creating an account, joining Illustration Québec (“IQ”, “the Association”, “we”) or using the members’ area of the site, you acknowledge that you have read, understood and accepted these terms of use. If you do not agree to them, please do not create an account or use the services reserved for members.
2. Eligibility and account
You agree to provide accurate and up-to-date information when you register and to keep it current. You are responsible for keeping your login credentials confidential and for all activity carried out from your account.
3. Membership, renewal and payment
Certain features, including listing in the directory and publishing a portfolio, require a valid paid membership. The rates, payment terms and membership categories (student, regular, add-on options) are indicated at the time of registration. Unless otherwise stated, membership is valid for the announced period and may be renewed according to the terms then in effect. Amounts paid are non-refundable, except where required by mandatory legal provisions or expressly stated by us.
4. Content posted by members
You retain ownership of the rights to the works, images, texts and other content you post (your “content”). By posting it, you grant Illustration Québec a non-exclusive, royalty-free and revocable licence to host, display and distribute this content as part of the directory, the site and the Association’s communications (for example newsletters, social media and member promotion). You may withdraw your content by deleting it or by terminating your membership.
You represent and warrant that you hold all the rights necessary to the content you post, that it does not infringe any copyright, trademark, image right or other right of a third party, and that it is not defamatory, hateful or illegal. You are solely responsible for the content you post.
5. Original works and commitment regarding artificial intelligence
Illustration Québec values human illustration work. Accordingly, you agree to post, both in your portfolio and in any public section of the site, only works of which you are the author and that result from your own personal creative work.
You expressly agree not to post images generated in whole or in part by generative artificial intelligence tools (for example, images produced from text prompts by image-generator systems). The use of digital tools that assist creation (drawing, retouching, colouring software, etc.) remains permitted, insofar as the work results from a genuine human creative process and not from automated generation.
Illustration Québec reserves the right to request clarification or proof of authorship of a work, and to remove any content that contravenes this article, without prejudice to the other remedies provided for in article 8.
6. Acceptable use
You agree to use the members’ area in good faith and not to: post illegal or misleading content, or content that infringes the rights of others; impersonate another person; attempt to gain unauthorized access to accounts, data or protected parts of the site; disrupt the operation of the site or circumvent its security measures; or use the directory or members’ contact information for unsolicited solicitation or mass data collection.
7. Illustration Québec’s intellectual property
The site, its name, logos, structure and the content produced by the Association are protected and remain the property of Illustration Québec or its licensors. Nothing in these terms transfers to you any rights to these elements, other than the right to use the site in accordance with these terms.
8. Suspension and termination
You may terminate your membership at any time from your account or by writing to us. We may suspend or terminate an account, remove content or deny access to the members’ area, in particular in the event of a breach of these terms, and especially of the commitment set out in article 5. Where possible, we will notify you. Termination does not give rise to any refund, subject to article 3.
9. Disclaimer of warranties and limitation of liability
The site and the members’ area are provided “as is”, without warranty of continuous availability or freedom from errors. To the extent permitted by law, Illustration Québec cannot be held liable for indirect damages arising from the use of or inability to use the site, nor for content posted by members or for relationships established between members and third parties through the directory.
10. Changes
We may amend these terms to reflect the evolution of our services or of the legal framework. The up-to-date version will be published on the site with its effective date. Continued use of the members’ area after a change constitutes acceptance of the revised version.
11. Governing law
These terms are governed by the laws applicable in the Province of Quebec and the laws of Canada applicable therein.
